Governing Law. This Agreement will be governed by and construed in accordance with the substantive laws of the State of Delaware without regard to conflict of laws and all disputes arising under or relating to this Agreement shall be brought and resolved solely and exclusively in the State Court located in Delaware
👆 This, or similar, is a paragraph many are familiar with in contracts or even in “Terms of Service” (those pages you never read when registering a new account somewhere).
Historically, this hasn’t been a problem, but could it become one now when the USA is imploding?
Well, I don’t know. I guess no one else does either…
However, now is a good time to make a case for having European or Norwegian law as the governing law. It’s reasonable to question whether the American legal system can be trusted when one person can (at least attempts to) override it. It’s not unreasonable to demand that any conflicts be resolved in a stable rule of law.
IMO.
A good overview of the American legal system from nrk.no here.
